Heroic Breath Terms of Service, Health Warning & Participant Waiver

These Terms of Service and Participant Waiver (“Agreement”) govern access to and participation in online and in-person programs, workshops, courses, memberships, coaching, breathwork sessions, recordings, digital products, and services offered by Heroic Breath, Inc. (“Heroic Breath,” “Company,” “we,” or “us”).
This Agreement applies whether access is purchased, discounted, or provided at no cost, including free access. By completing the required agreement acknowledgment at checkout or registration, you (“Participant”) agree to this entire Agreement, including the health warning, contraindications, assumption of risk, and release of liability below.
1. Eligibility
You must be at least eighteen (18) years old and legally able to enter this Agreement to participate in any Heroic Breath program or service.
2. Important Health Warning and Contraindications
DO NOT PARTICIPATE IN HEROIC BREATH IF YOU HAVE ANY OF THE FOLLOWING CONDITIONS:⚠️
Epilepsy
Detached retina
Glaucoma
Bipolar disorder or schizophrenia diagnosed by a healthcare professional
Post-traumatic stress disorder (PTSD), unless your healthcare provider has cleared you to participate
Osteoporosis serious enough that active movement could cause injury
High blood pressure that is not controlled with medication
Pregnancy
Cardiovascular disease or irregularities, including a prior heart attack or arrhythmia
A family history of aneurysms
Use of prescription blood thinners, such as Coumadin
Hospitalization for a psychiatric condition or emotional crisis within the past ten (10) years
A history of stroke, seizure, transient ischemic attack (TIA), or another neurological condition or disease
Any other medical, physical, or mental health condition that could affect your ability to participate safely in breathwork or emotional release
If you have asthma, keep your prescribed inhaler nearby. If you are unsure whether participation is safe for you, consult your physician or mental health provider before participating.
By agreeing to this Agreement, you confirm that you have reviewed this warning and will not participate if a listed condition applies to you, except where the warning expressly allows participation with healthcare-provider clearance and you have obtained that clearance.
3. Educational Purpose
Heroic Breath programs are intended for education, personal development, wellness, and self-exploration. They are not medical treatment, psychotherapy, mental health counseling, diagnosis, or healthcare services. Heroic Breath facilitators do not provide medical or mental health advice through these programs. Consult qualified professionals about medical or mental health concerns.
4. Nature of Participation and Risks
Heroic Breath may involve deep or accelerated breathing, music, physical sensations, and emotional exploration. Possible effects include dizziness, tingling, muscle tightness, changes in breathing, and physical or emotional distress. Experiences and responses vary and may be unpredictable.
Participation is voluntary. You agree to stop immediately if you feel unsafe or experience concerning symptoms and to seek appropriate medical care when needed. Do not participate while driving, in water, or while doing anything that requires your full attention.
5. Participant Responsibility and Assumption of Risk
You are responsible for deciding whether to participate, following applicable instructions, and choosing a safe place for your session. You understand the risks described in this Agreement and voluntarily assume the risks inherent in your participation.
Nothing in this Agreement requires you to continue a session when you feel uncomfortable or unsafe.
6. Participant Waiver and Release of Liability
To the extent permitted by applicable law, you release Heroic Breath, Inc. and its officers, directors, employees, contractors, facilitators, apprentices, and agents from claims for injury, loss, or damage arising from your participation, including claims based on ordinary negligence where such a release is permitted by law.
This release does not apply to any claim or conduct that cannot legally be waived. A court may determine that some or all of this release is unenforceable.
By signing this document you may be waiving your legal right to a jury trial to hold the provider legally responsible for any injuries or damages resulting from risks inherent in the sport or recreational opportunity or for any injuries or damages you may suffer due to the provider's ordinary negligence that are the result of the provider's failure to exercise reasonable care.
7. No Guarantee of Results
Individual experiences vary. Heroic Breath does not guarantee any particular physical, emotional, health, personal development, business, or other outcome from participation.
8. Confidentiality
If you participate with others, you agree to respect their privacy and not disclose personal information, comments, or experiences they share during a Heroic Breath program without their permission.
9. Intellectual Property and Recording Restrictions
Heroic Breath’s videos, audio, recordings, course materials, written content, graphics, branding, and other original materials remain the property of Heroic Breath or their respective owners.
Your access is for your personal use. You may not record a session or reproduce, distribute, publish, share, sell, or create derivative works from Heroic Breath materials without prior written permission, except as permitted by law.
10. Right to Refuse or End Participation
Heroic Breath may refuse, suspend, or end participation when reasonably necessary for safety, misconduct, or a violation of this Agreement. Any refund rights provided by an applicable purchase policy or law remain unaffected.
11. Website and Content Disclaimer
Information on heroicbreath.com and in Heroic Breath programs is provided for informational and educational purposes. It is not intended to diagnose, treat, cure, or prevent disease.
12. Limitation of Liability
To the extent permitted by law, Heroic Breath, Inc. and its officers, directors, employees, contractors, facilitators, apprentices, and agents will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from use of a Heroic Breath product or service. This section does not limit liability where doing so is prohibited by law.
13. Dispute Resolution
Any legal action arising from this Agreement must be brought in the state courts located in Missoula County, Montana, or, if federal jurisdiction exists, the United States District Court for the District of Montana, Missoula Division.
14. Attorneys’ Fees
If Heroic Breath, Inc. prevails in an action arising from this Agreement, it may seek reasonable attorneys’ fees, costs, and expenses to the extent permitted by applicable law.
15. Severability
If a provision of this Agreement is found invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
16. Governing Law and Venue
Montana law governs this Agreement. The parties consent to the jurisdiction and venue of the courts identified in Section 13, unless applicable law requires otherwise.
17. Duration and Changes
Your acceptance of this Agreement applies to your participation in Heroic Breath programs and services for twenty-four (24) months from the date you accept it. Heroic Breath may require you to accept an updated agreement sooner if the terms or nature of a program materially change. Participation after the twenty-four-month period requires a new acknowledgment.
18. Acknowledgment
By checking the required agreement box at checkout or registration, you confirm that you have read and understood this entire Agreement, including its health warning, contraindications, assumption of risk, and participant waiver. You confirm that you are at least eighteen (18) years old, meet the eligibility requirements, and voluntarily agree to these terms. Your acknowledgment applies whether your access is paid, discounted, or provided at no cost.
