Terms of Service 1 — Heroic Breath

Heroic Breath Terms of Service

These Terms of Service ("Terms") govern participation in any online or in-person programs, workshops, courses, memberships, coaching, breathwork sessions, recordings, digital products and services offered by Heroic Breath, Inc. ("Heroic Breath," "Company," "we," or "us").

By accessing, purchasing, registering for or participating in any Heroic Breath service, program or product, you agree to be bound by these Terms of Service, as well as any Participant Waiver, Release and Assumption of Risk Agreement and Medical Contraindications Checklist required by Heroic Breath.

1. Eligibility

You must be at least eighteen (18) years of age to participate in any Heroic Breath program or service.

2. Educational Purpose

Heroic Breath programs are intended for educational, personal development, wellness and self-exploration purposes only.

Heroic Breath services are not medical treatment, psychotherapy, mental health counseling, diagnosis or healthcare services. No information provided by Heroic Breath should be interpreted as medical, psychological, or psychiatric advice.

4. Participant Responsibility

Participants remain solely responsible for their own physical, emotional, psychological and mental well-being before, during and after participation.

Participants agree to follow all instructions provided by Heroic Breath and to discontinue participation if they experience discomfort, distress or concerns regarding their well-being.

5. Confidentiality

Participants agree to respect the privacy of other participants and shall not disclose personal information, comments, experiences or discussions shared by others during any Heroic Breath program without express permission.

6. Intellectual Property

All Heroic Breath content, including videos, recordings, audio tracks, course materials, written content, graphics, branding, trademarks and proprietary methodologies remain the exclusive property of Heroic Breath, Inc.

Participants may not reproduce, distribute, publish, record, share, sell, modify, or create derivative works from any Heroic Breath materials without prior written permission.

7. Recording Restrictions

Participants may not audio record, video record, screen record, reproduce, distribute or publicly share any portion of Heroic Breath programs without prior written consent from Heroic Breath.

8. Right to Refuse or Terminate Participation

Heroic Breath reserves the right to deny, suspend or terminate participation in any program or service at its sole discretion and without obligation to provide a reason.

Information provided on heroicbreath.com and through Heroic Breath services is for informational and educational purposes only.

10. Limitation of Liability

Should Heroic Breath prevail in any action arising from these Terms, Heroic Breath shall be entitled to recover its reasonable attorneys' fees, costs and expenses.

13. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Governing Law and Venue

These Terms shall be governed by the laws of the State of Montana.

Any litigation arising from these Terms shall be brought exclusively in Missoula County, Montana and participants consent to the jurisdiction of such courts.

15. Term

Acceptance of these Terms shall remain effective for twenty-four (24) months from the date of acceptance and shall apply to all Heroic Breath programs, events, sessions, products and services utilized during that period.

By participating in any Heroic Breath program or service, you acknowledge that you have read, understood and agreed to these Terms of Service.
